Agreement to Terms

By accessing our website or engaging our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services Provided

OmniQuake Media provides the following services:

• Custom website design and development
• Search engine optimization (SEO) services
• Conversion rate optimization (CRO)
• Website maintenance and support
• Digital strategy consulting

Project Scope & Estimates

All project quotes are estimates based on the initial scope discussed. The final project cost may vary if:

• The project scope changes or expands during development
• Additional features or pages are requested after project commencement
• Timeline adjustments are requested by the client

Payment Terms

Project Timelines

Estimated project timelines are provided at the start of each engagement. Timelines may be affected by:

• Delayed client feedback or approvals
• Scope changes during development
• Unforeseen technical complexities
• Third-party service delays (hosting, plugins, etc.)

Revisions Policy

Each project includes a defined number of revision rounds as specified in your proposal. Additional revisions beyond the agreed scope will be billed at our standard hourly rate.

Client Responsibilities

Clients are responsible for:

• Providing timely feedback and approvals
• Supplying content, images, and materials in a timely manner
• Ensuring they have rights to all materials provided
• Providing domain access and hosting credentials when needed
• Reviewing and testing deliverables

Intellectual Property

We reserve the right to use pre-built components, frameworks, and tools in your project. These remain our intellectual property and may be used in future projects.

Third-Party Services

Our services may involve third-party services such as domain registrars, web hosting providers, email services, and analytics platforms. We are not responsible for the policies or performance of these third-party services.

Warranties & Disclaimers

We warrant that our services will be performed with reasonable skill and care. However, we cannot guarantee specific results (such as search engine rankings or conversion rates) as these depend on many factors beyond our control.

Our services are provided "as is" without warranties of any kind, either express or implied, except as expressly set forth in this agreement.

Limitation of Liability

To the maximum extent permitted by law, OmniQuake Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or business opportunities, resulting from the use of our services.

Termination

Either party may terminate this agreement with 14 days written notice. Upon termination:

• All work in progress will be delivered to the client
• Payment is due for all work completed up to the termination date
• The deposit is non-refundable for work already begun

Confidentiality

We treat all client information as confidential and do not share it with third parties, except as necessary to provide our services or as required by law.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which OmniQuake Media operates, without regard to its conflict of law provisions.
